NBN23 S.L. (“NBN23”), with registered address at Juan de la Cierva y Codorniu numero 27 Edificio Wellness 1 Planta 3 46980-Paterna and VAT number B40634206, has launched a draw following Terms and Conditions.
FIRST. – SCOPE OF APPLICATION
In order to participate in the draw and acknowledging and accepting the participation conditions, each user must register on the form and participate in the beta version of FIBA Basketball Challenges.
Once the participation period has ended, a draw will be held among those who are part of the user database of the FIBA Basketball Challenges App.
The draw will take place on 16th October 2024. In case the program is suspended, all users participating in this initiative will be contacted via email.
SECOND. – OBJECTIVE
The objective of the draw is to win 2 tickets for the Eurobasket 2025 event.
THIRD. – PARTICIPATION CONDITIONS
The participation requirements are as follows:
Only participants who are account holders of FIBA Basketball Challenges can participate.
Participants must be aware of and accept the participation conditions and personal data processing.
Participants can only participate with one profile. If it is discovered that a participant is using multiple profiles, they will be disqualified.
FOURTH. – PARTICIPATION MECHANICS
The participant has to signup the form appears on the FIBA Basketball Challenges landing page and also create a new account on FIBA Basketball Challenges App. It has to be part of the BETA Tester version.
FIFTH. – PRIZES
The prize will consist of 2 tickets for Eurobasket 2025.
The prize cannot be exchanged for cash or any other prize, nor can it be subject to modification or alteration.
The company reserves the right to modify the prize if, on the day of declaring the participant as the winner, there are stock problems with the prize, and therefore, it is impossible to provide the same.
SIXTH. – ANNOUNCEMENT OF WINNERS AND PRIZE NOTIFICATION
Once the participation period has ended, the winner will be selected.
For this draw, the list of participants will be downloaded and the Easy Promo platform will be used: https://www.easypromosapp.com/es/.
The announcement of the winner will be made through the winner’s email.
The winner must confirm acceptance of the prize via email by writing to marketing@nbn23.com within a period of seven (7) natural days following the notification.
In response to this email, NBN23 will inform the winner how to collect the prize.
SEVENTH. – ACCEPTANCE OF PRIZE AND PRIZE DELIVERY
Upon confirmation of acceptance by email, the winner must provide their full name, last name, and complete postal address.
EIGHTH. – DISQUALIFICATIONS AND PENALTIES
If it is found that any of the participants do not meet the requirements specified in the Terms and Conditions, or if the provided data for participation is not valid, their participation will be considered void, and they will be automatically excluded from the promotion, losing all rights to the prizes awarded under this promotion. The company reserves the right to declare the draw void.
NINTH. – TRANSFER OF PRIZES
Under no circumstances can the prizes and incentives be changed, altered, or compensated upon the winner’s request. NBN23 reserves the right to substitute the prizes with others of equal or higher promotional value if deemed necessary.
TENTH. – TAXATION
The prize awarded within the contest will be subject to Law 35/2006 of November 28, on Personal Income Tax and other corresponding provisions. Therefore, if required by current regulations, NBN23 will be responsible for making the necessary withholding or payment on account of Personal Income Tax (hereinafter “IRPF”).
In this regard, in accordance with the provisions of Article 101.7 of Law 35/2006, of November 28, on Personal Income Tax, and Article 75.3.f) of the Regulation for the Development of that Law, NBN23 must apply the appropriate withholding or advance payment regarding any prize related to the contest whose value exceeds €300, or any values that are legally required at any given time.
The prize awarded within the framework of the program will be considered capital gains not generated by the transfer of assets, so it must be taken into account when filing the Personal Income Tax (IRPF) declaration and will be subject to taxation on the general taxable base, with the final tax treatment of the prize depending on its value and the amount of other income obtained by the winning participant.
In relation to the above and in compliance with current tax regulations, NBN23 will apply the corresponding withholding or advance payment on the awarded prize and will issue the appropriate certification to facilitate the Participant’s compliance with their tax obligations, as they will need to include the received prize income in their IRPF declaration along with their other earnings, deducting the amount specified in the mentioned advance payment certification as already paid.
By accepting the prize, the winning participant authorizes NBN23 to apply, on behalf of the winner, the appropriate withholding or advance payment corresponding to 19% of the prize value, or the percentage legally required at any given time.
The non-enjoyment of the prize by the winning participant will not exempt them from considering its value as capital gains not generated by the transfer of assets for the purposes of their IRPF declaration. MUTUACTIVOS will not be responsible in any case for any incorrect tax declaration that the prize winner may make.
ELEVENTH. – ACCURACY OF DATA
The data provided by the participants must be accurate. In the event that they are false, the prizes that they would have been entitled to will be redrawn.

All the data you provide for participation in the contest is necessary for its formalization and management. We ask that all the data you provide be up to date to ensure its truthfulness at all times, therefore, any modification of this data must be communicated to us so that it always corresponds to your actual situation.
The legal basis that enables MUTUACTIVOS to carry out this processing is:
● The processing is necessary for the management of the contest (Article 6.1.b GDPR).
● Compliance with legal obligations, in accordance with Article 6.1.c GDPR.
RECIPIENTS: The data will not be transferred to third parties, except for legal obligations.

Furthermore, if you wish, you can file a complaint with the Spanish Data Protection Agency if you believe that the processing we are carrying out is contrary to current regulations. The submission of data implies express acceptance for the execution of the aforementioned data processing. It is essential to fill in all the required data in order to process your request. Data of minors cannot be provided. If such data were provided, they would be destroyed, and those individuals would not be able to participate in the contest.
THIRTEENTH. – COMPLAINTS
The period for filing a complaint regarding the outcome of each challenge will end one (1) calendar day after the publication date of the winners of each challenge, as established in section Seven of these terms. Users who wish to do so can submit any complaints about the contest to the email address marketing@nbn23.com.
FOURTEENTH. – AMENDMENT OF TERMS AND SUSPENSION OF THE DRAW
NBN23 reserves the right to suspend, postpone, or cancel the draws at any time, provided there are justified reasons to do so, as well as to modify these terms. NBN23 undertakes to communicate the new terms, conditions, suspension, postponement, or cancellation, if applicable, through the same channels and in the same manner.
FIFTEENTH. – LIABILITY EXEMPTION
By way of illustration, but not limited to, we are not responsible for any possible losses, thefts, delays, or any other circumstances attributable to third parties that may affect the development of this Promotion, nor do we assume responsibility for the Participant’s use of the prize obtained from this Promotion. We do not assume responsibility in cases of force majeure or fortuitous events that could prevent the realization of the Promotion or the full or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to detected fraud, technical errors, or any other reason beyond the control of the Company that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation website.
SIXTEENTH. – APPLICABLE LAW AND JURISDICTION
These legal terms shall be governed by Spanish law. The Courts and Tribunals of the city of residence of the organizer shall have jurisdiction to resolve any claims or disputes that may arise in relation to the validity, interpretation, or compliance with these terms.
